The 14th Amendment Section 3 states that if a person takes an oath to uphold the constitution and then engages in insurrection against the same, they are subsequently barred from holding any future office in the United States. Section 3 also states that a two-thirds vote in both chambers of Congress can remove the disability. This step is not a formality. It is required. The two-thirds vote also represents the American people's consent to be governed by an oath breaker. On January 6, 2025, this vote never took place. Without Trump's disability being removed (without the people's consent), the certification ceremony became an extra constitutional act.

Vice President Kamala Harris claimed her role was strictly ceremonial. Nevertheless, the vice president was under no obligation to preside over an illegal ceremony and should have objected. Not a single Senator or Representative voted to give the people's consent, and we, the petitioners, do not consent. Because the vice president and Congress failed to honor their oaths to uphold the constitution, specifically the 14th Amendment Section 3, they have joined Trump at the hip as oath breakers. That Mr. President, is more insidious than what happened on January 6, 2021.

However, there are unilateral actions you can take to address this matter. There are a concerning number of world renowned psychiatrists, psychologists, and other mental health professionals who have already assessed that Donald Trump is unfit and dangerous,  (1). Consider Trump's handling of the COVID-19 pandemic. According to the Brookings Institution, his failed response resulted in hundreds of thousands of avoidable deaths, (2, 3). Trump undermined his own health experts, notoriously downplayed the threat, and his nomination of Robert F Kennedy Jr. (and others) as Secretary of Health and Human Services further highlight his potential to cause additional harm and put American lives at risk (4). In my opinion, Trump's handling of the COVID-19 pandemic was homicidally negligent and should have resulted in impeachment, arrest, and criminal prosecution.

Another glaring illustration is Trump’s persistent dog whistling to hate groups, which began during his campaign announcement in 2015 and continues to this day, (5, 6). It is no coincidence that Trump's reckless language during his first term resulted in a record high in the number of hate groups in our country (7), and most prominently, Trump's Big Lie culminated in the January 6 Capitol insurrection.

When the people vote for a presidential candidate, they are not simply voting for him or her, they are also voting for their running mate and agenda. The peaceful transfer of power does not have to be interrupted. If Trump is found to be unfit, JD Vance can take office in his stead. Per the 25th Amendment, the president is required to be fit of mind.

The people demand that President Joseph R Biden declare a national emergency for reasons related to public safety, national security, and our constitutional integrity. You must insist that Donald Trump be subjected to a comprehensive psychological evaluation by a team of independent mental health experts and that the process be transparent to the public. We also demand that a panel of mental health experts be allowed to testify before Congress to articulate the danger that Donald Trump poses to the American public.

President Biden, I do not envy you. Nevertheless, in this moment, now more than ever, you must live up to your oath to preserve and protect the constitution. The felon, Donald Trump, is dangerous and a national security threat. You know this better than me. For public safety, our national security, and constitutional integrity, you cannot allow Trump to take office again. If you fail to act, history will look back at this moment in horror, and you will leave an indelible stain on your, and your administrations, legacy. President Biden, I have a favorite quote from Dr. King, "the time is always right to do what is right," and, to paraphrase, it's never too late to do what is right. I hope you will choose wisely.

Action Plans

If you are in Washington, protest everyday until President Joseph Biden addresses this matter. I recommend two protest signs. 1, The Media Is Failing, Fascism Is Prevailing. 2, Traitor Trump's Devices, Constitutional Crisis. 

Trump's devices? The Big Lie, obstruction of justice, insurrection, fraud ....

I do not view what happened on January 6, 2025, as a peaceful transfer of power. In fact, what happened this year is likely more insidious than what happened in 2021.
